1. Acceptance of Terms

By accessing or using Simpay Food Services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Services Provided

Simpay Food Services provides:

• Online food ordering and delivery from partner restaurants
• Train seat food delivery using your PNR number across 500+ Indian railway stations
• Platform for restaurants and delivery partners to register and operate

3. User Responsibilities

• You must provide accurate information when placing orders or registering
• You are responsible for maintaining the security of your account
• You must not use the platform for any unlawful purpose
• For train orders, you are responsible for providing the correct PNR and station details

4. Order & Payment Policy

• All prices displayed on the platform are inclusive of applicable taxes
• Payment must be completed successfully for the order to be confirmed
• Simpay Food Services reserves the right to cancel orders that cannot be fulfilled
• For train food delivery, orders must be placed at least 2 hours before the scheduled arrival at the delivery station

5. Cancellation Policy

• Orders can be cancelled within 5 minutes of placement for a full refund
• After preparation begins, cancellation may not be possible
• Train food orders cannot be cancelled once the train has passed the order cut-off point
• Restaurant-initiated cancellations will result in a full refund

6. Delivery & Service Standards

• Delivery times are estimates and may vary due to traffic, weather, or restaurant delays
• We cannot guarantee delivery times for train food orders during rail delays or schedule changes
• Simpay Food Services is not liable for food quality issues caused by restaurant partners

7. Partner Terms

For Restaurant and Delivery Partners:

• Partners must hold valid licenses (FSSAI for restaurants, driving license for delivery partners)
• Partners are responsible for the accuracy of their listed information
• Simpay Food Services may suspend partner accounts for policy violations
• Commission rates and payment terms will be specified in the individual partner agreement

8. Limitation of Liability

Simpay Food Services shall not be liable for any indirect, consequential, or incidental damages arising from use of our services. Our maximum liability is limited to the amount paid for the specific order in question.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in India. We encourage resolving disputes through our customer support before seeking legal remedies.
